Jurors in the Bradley Dial murder trial on Wednesday heard parts of a tape-recorded statement his daughter made last year. Prosecutors argued the statement contradicted her testimony that she lied when she told officials her father abused the boy he’s accused of killing.

On Monday, Shawna Rivera, 15, told jurors she lied when she said her father physically abused his former girlfriend’s son, Jose “Joey” Torres, 8, who was found beaten to death in Dial’s Hobe Sound mobile home on June 26, 2000.

She said she lied when she said she saw her father hit Joey the night before he was found dead in bed by his mother, Tammy Huff.

Jurors listened to a February 2002 tape recording of Rivera sobbing to Martin County authorities about how she was “tired of lying” and had something to tell them about her father’s role in Joey’s death.

“This has been bothering you?” Sheriff’s Detective John Cummings asked, according to the tape.

“Yes,” replied Rivera, who was 13 at the time.

“I’m tired of lying. … I just, like, knew the whole time but I didn’t say anything,” Rivera said, when asked why she was meeting with prosecutors after she’d already given a statement.

Prosecutors are seeking the death penalty for Dial, 38, who is charged with first-degree felony murder, aggravated manslaughter of a child and aggravated child abuse.

The emotional teenager could be heard saying Dial’s mother, Dana Brewer, told her “not to say anything” about her father’s involvement.

During the taped interview, which backed up much of what her younger brother Curtis Rivera told jurors last week, Rivera said she’d come forward voluntarily and that no one had forced her to talk.

“He always used to hit Joey all the time,” Rivera said. “And he hit him all the time, every day. I don’t know why.”

“Did you see your dad hit Joey at that trailer in Hobe Sound?” Cummings asked.

“Yes,” she said, adding that she saw Dial kick Joey “everywhere.”

“He cried, and whenever he cried, they’d hit him more and tell him not to cry,” she recalled on the tape.

She said she saw her father and Huff — who also faces murder charges — abuse Joey the weekend before he died.

Closing arguments are scheduled for this morning.
